Setting up an Incorporated Charitable Trust

Outline of process
1. Your group wants to set up an incorporated charitable trust.
2. Meet and decide:
a. A name for the trust.
b. Who will be the trustees and how they will operate.
c. A draft trust deed using sample deed in this kit.
3. Ring 0508 COMPANIES (or go to www.societies.govt.nz, click on ‘Library’) and print off or request the following:
a. Application form (2 copies needed).
b. A statutory declaration form.
c. Charitable Trusts | General Information.
d. Any other relevant material from the website.
4. The Companies Office sends you all the documents you have requested.
5. Call a meeting of the Trust Board. At this meeting trustees agree to:
a. Complete the application for incorporation (including registered office details).
b. Approve the Trust Deed
c. Complete the declaration form.
d. Elect a Secretary, Treasurer and any other officers.
6. Send the completed documents back to the Companies Office, Ministry of Economic Development:
a. Name approval document.
b. 2 original copies of Application for Incorporation document.
c. 2 copies of your trust deed.
d. Declaration form.
7. The Companies Office, Ministry of Economic Development informs your group that it is now an incorporated charitable trust and posts a certificate of incorporation.
