New Self-Help Resource for Protection of Personal and Property Rights Act applications

The McKenzieTrust has generously funded a new self-help resource on making applications to the Family Court for orders under the Protection of Personal and Property Rights Act.

These orders could be for welfare guardianship or property management and are needed when someone has lost the capacity to act for themselves and there is no enduring power of attorney in place.

This guide is particularly relevant to elderly persons or parents of disabled children who need to make such an application when their children reach 18 (in fact the case study in the resource covers just such a scenario).

We have produced a range of other self help resources including one on making an enduring power of attorney which can be downloaded free from the website.

The law in this area will change in September 2008 and will require certification by a lawyer or legal executive.

Until this date, persons can use this "do it yourself" resource without the need to get a lawyer involved.
